1. Service Description
Travel Assistant provides a smart WhatsApp bot service ("the Service") that helps tourists discover restaurants, attractions, and services worldwide using Google Maps integration. The Service is offered to travel agencies ("Clients") who provide it as a value-added feature to their tourists ("End Users").
2. Acceptance of Terms
By accessing our website or using the Service, you agree to be bound by these Terms of Service. If you are entering into this agreement on behalf of a travel agency, you represent that you have the authority to bind the agency to these terms.
3. Service Access
Access to the Travel Assistant bot is provided to End Users based on trip dates submitted by the Client:
- Access is activated 1 day before the trip start date
- Access remains active for the duration of the trip
- Access is deactivated 1 day after the trip end date
The Client is responsible for obtaining consent from End Users before sharing their phone number and trip information with Travel Assistant.
4. Pricing and Payment
- The standard rate is €20 per tourist per trip
- Volume discounts are available for agencies with 100+ tourists per month
- Payment terms and billing frequency are agreed upon in the individual service agreement
- All prices are exclusive of applicable taxes
5. Free Trial
We offer a 7-day free trial for agency managers to evaluate the Service. The trial includes:
- Full access to all Service features
- No credit card required
- No automatic billing after the trial ends
- Trial is limited to one per agency
6. Client Responsibilities
As a Client, you agree to:
- Obtain proper consent from End Users before sharing their personal data with us
- Provide accurate tourist information (name, phone number, trip dates)
- Inform End Users about the Travel Assistant service and how their data will be used
- Comply with all applicable data protection laws, including GDPR
- Not use the Service for any unlawful purpose
7. Service Availability
We strive to maintain 99.9% uptime for the Service. However, we do not guarantee uninterrupted access and are not liable for:
- Temporary unavailability due to maintenance (with advance notice when possible)
- Disruptions caused by WhatsApp or Google Maps Platform outages
- Force majeure events
8. Accuracy of Results
Location search results are provided by Google Maps Platform. While we strive to deliver accurate and relevant results:
- We do not guarantee the accuracy, completeness, or timeliness of search results
- Business information (hours, ratings, availability) may change without notice
- We are not responsible for the quality of services at recommended locations
- Results are informational and do not constitute endorsements
9. Intellectual Property
All intellectual property rights in the Service, including software, algorithms, and branding, remain the property of Travel Assistant. Clients receive a non-exclusive, non-transferable license to use the Service for the duration of their agreement.
10. Branding
Clients may request to use their agency name for the WhatsApp bot. This customization is included in the Service at no additional cost. The Client grants Travel Assistant permission to display the Client's brand name within the bot interface.
11. Limitation of Liability
To the maximum extent permitted by law:
- Travel Assistant is not liable for any indirect, incidental, or consequential damages
- Our total liability shall not exceed the fees paid by the Client in the 12 months preceding the claim
- We are not liable for damages arising from End Users' reliance on search results
12. Termination
- Either party may terminate the agreement with 30 days written notice
- We may suspend the Service immediately if the Client violates these Terms
- Upon termination, all End User data will be deleted within 30 days
- Outstanding invoices remain payable after termination
13. Data Processing Agreement
For GDPR compliance, we offer a Data Processing Agreement (DPA) to all Clients. The DPA outlines our obligations as a data processor, including security measures, sub-processor management, and data breach notification procedures. Contact us to request a DPA.
14. Governing Law
These Terms are governed by and construed in accordance with the laws of Ireland. Any disputes arising from these Terms shall be resolved through amicable negotiation first, and if unsuccessful, through the competent courts of Ireland.
15. Changes to Terms
We reserve the right to modify these Terms at any time. Material changes will be communicated to Clients via email at least 30 days before taking effect. Continued use of the Service after changes constitutes acceptance of the updated Terms.
